I am on Social Security Disability, do I need to pay child support?
Child support is based on your work situation and income. Since you are on Social Security disability, your income will be very limited. For one, Social Security has rules on just how much income you can earn if you want to keep your disability benefits. Thus, based on your income, you may be required to pay very little by way of child support.
However, there still is a way for you to fulfill your obligation.
Social Security also provides benefits for your dependent children who are below 18 years old. When your children are eligible to receive benefit payments from Social Security, you can go to the court with this information and the fact that you are disabled. You can request the court to compute for your revised child support obligation.
The court will review your child support obligation prior to your disability, as well as your individual situation. And then they may come out will a revised child support obligation.
Please note that this will not cover any child support that is overdue. The revised child support obligation will start after the court ruling. Even if you have been disabled and are on the process of applying for Social Security disability benefits, your child support obligations for the month this period covers will still be payable by you.
The best thing you can do is to consult a lawyer to know the steps you need to take so that you can ask the court to review your child support obligation.
